Abstract. Crime, as one of the forms of illegal behavior throughout the existence of mankind, has been a serious threat. According to the author of the article, no less, if not more, threat is posed by the crime that is committed by convicts while serving a sentence of imprisonment. For sovereign Kazakhstan, as one of the states formed on the territory of the former Soviet Union, this problem is of great importance. First of all, this is due to the fact that it is somehow connected with crime outside the walls of the correctional institution. This type of crime is a definite manifestation of recidivism or its direct consequence. Considering that a specific society is formed in conditions of places of deprivation of liberty, the system of relations that exists among convicts may be characterized by certain specifics. Two independent directions have been formed in science, the subject of which is the criminality of convicts. This phenomenon is considered by penitentiary sociology and penitentiary criminology. It is within the framework of the latter that Kazakh penitentiaries determine the priorities of their research. The author convincingly shows that the states formed on the «fragments» of the former Soviet Union, in fact, formed a specific criminal environment in a closed penitentiary society. This social community has developed its own rules and traditions. According to these informal norms, you not only evaluate the behavior of the convict within the penitentiary society, but also determine the priorities of his life. According to the author, the administration of the correctional institution does not always cope with the challenges that the penitentiary community throws at it.

Keywords: penitentiary crime; crime in the Republic of Kazakhstan; penitentiary community; leaders of the criminal environment; informal traditions in places of detention; penitentiary society; penitentiary prevention
