National sovereignty and the rule of law in the context of social transformation in modern political reality

Abstract. The article examines the political and legal categories of «national sovereignty», «state sovereignty» and «rule of law» in the context of dynamics and transformation of social processes. The necessity of their essential understanding in the conditions of modern political reality as the fundamental foundations for the formation of vectors of domestic, foreign and global policy is substantiated. The author conducts a study of the described problems from the perspective of a fairly general theory of management using general scientific and special methods of cognition. The architectonics of the presentation of the material is based on the author’s formulation of the essential characteristics of the basic concepts of the study: «politics», «statehood», «power». The author identifies the signs of state and national sovereignty, correlates these categories and formulates concepts. State sovereignty is considered in the aspect of the authoritarianism of the exercise of power in all elements of the social system within society, foreign and global politics. National sovereignty is considered as the basic principle of the organization of democracy, as the development and self-organization of civil society free from internal and external pressure, and as a real, direct and indirect management of social processes. It defines the rule of law in a narrow (realized in the conditions of modern political and legal reality) and broad (theoretically idealized) senses. Analyzes them, identifies distinctive features correlating with the category of «civil society» in the context of social dynamics and the organization of management of public processes. In conclusion, the author makes a scientific generalization and a conclusion about the relevance of the problems of national sovereignty of modern civil society in the context of constructing a new political space, the role of the state and society in regulating the system of social relations.
