Abstract. Punishment in the form of imprisonment traditionally refers to the most problematic form of social activity. One of the main problems in the specialized literature is the presence of the so–called penitentiary community. This social community has a negative impact not only on the life of a contour convict in a closed penitentiary society, but also creates conditions under which the implementation of this type of punishment acquires an exclusively negative character. An attempt to solve the problem of opposition to the correctional process by representatives of the penitentiary community, penitentiary criminologists and sociologists have not been able to unequivocally establish its nature. Two different conceptual approaches to defining the nature of the penitentiary community have been formed in the literature. The author of the article refers to those scientists who believe that the penitentiary community was formed not by the convict himself, but by representatives of law enforcement agencies in order to control the criminally active part of the country’s population. As a starting point, the author chose the work of the famous Russian philosopher I.A. Ilyin, in which he proposed to consider social communities by the nature of their formation based on their social purpose — «institution» or «corporation». The article attempts to apply the conceptual approach proposed by I.A. Ilyin. As a result of the analysis, the author came to the conclusion that at the stage of formation of the penitentiary community, «formal democracy» was used as the basic principle. The convicts included in the penitentiary community were peculiar representatives of the entire penitentiary society — the «corporation». However, over time, when socio-economic relations in the state began to change, in the organization of the penitentiary community, trends towards transformation began to be traced — the «institution».
