The spiritual and moral aspect of the progressive system of execution and serving of imprisonment

Abstract. The correct prioritization of punishment in the form of imprisonment is inextricably linked to its qualitative characteristics. One of the main conceptual categories in this regard is the «progressive system of execution of criminal punishment». The author of the article raises a legitimate question: can a progressive system of criminal penalties be implemented without observing certain spiritual and moral aspects? In the author’s opinion, it is necessary to analyze the spiritual and moral aspect of the progressive system of execution and serving of imprisonment in the context of interdisciplinary synthesis. Without the use of criminal punishment, spiritual and moral values remain, as a rule, out of sight of the convicted person. The formation of his spiritual and moral properties, their qualitative changes «incrementally» occur through a progressive system, its individual stages. The high systemic result associated with the possibility of obtaining conditional freedom may not continue where the spiritual and moral values in society have not been changed for the better. Such changes are related to the contrast that exists in the convict’s mind during his stay in a correctional institution. The convict’s desire to be released from prison as soon as possible in such conditions creates a distorted view of the meaning of his correction. It encourages him to adapt, in the worst case, to commit a new socially dangerous act. The author suggests a number of organizational and legal solutions in this area. First of all, they increase the effectiveness of the progressive system, which are based on spiritual and moral factors, without which it is difficult to achieve positive changes in the personality of convicts.
