In particular, the work notes that for many decades the \u00abprogressive system\u00bb has been considered as the main mechanism for ensuring the rights, freedoms and legitimate interests of the prematurely sentenced to imprisonment. The development of the Republic of Kazakhstan as a sovereign state over the past decades has been associated with the formation of legislation appropriate to modern realities. The main difficulty on this thorny path was the lack of the necessary theoretical and methodological framework. The previously existing regulatory framework was formed during the Soviet period, and, therefore, could not fully meet the requirements of modern realities. Especially considering Kazakhstan&#8217;s search for its own path as a sovereign state. According to the author of the article, the problems are caused by several independent problem fields: (1) the lack of adequate modern legislation; (2) an attempt to build \u00abprogressive\u00bb institutions of criminal punishment on the Soviet regulatory basis; (3) some discrepancies in the understanding of the same problems by legislators and scientists of Russia and Kazakhstan. The author makes a number of rather original recommendations and proposals that significantly change the criminal, criminal procedure and penal enforcement legislation, as well as increase the effectiveness of law enforcement activities of structural units of the penal enforcement (penitentiary) system.
