Abstract. Punishment in the form of imprisonment is traditionally assessed in domestic and foreign literature as one of the most controversial in terms of its goals and the practice of their implementation. The conceptual provisions that are embedded in the content of punishment in the form of imprisonment are formed on the basis of certain social concepts, through regulatory regulation. At the same time, the article notes that when forming both the «social order» and the forms of legal regulation of punishment in the form of imprisonment, the peculiarities of this state institution are not taken into account. The use of deprivation of liberty as an element of state coercion against persons who have committed socially dangerous acts has led to the formation of a specific penitentiary society in domestic practice. Like any social education, it could not fail to be formed as a special socio-cultural institution. Moreover, the authors note that this process was quite long-lasting, which allows us to establish that in various historical periods, it transformed along with the «big» («free») society. Experts present this process as a kind of extrapolation of changes in various state institutions, which could not leave aside the deprivation of liberty. The penitentiary society, in conditions of its closeness, has created conditions for the formation of a specific informal body — the penitentiary community. It began to act as a subject of managing the punishment process on an equal basis with the administration of places of deprivation of liberty. The presence of two opposing authorities act as a certain kind of obstacle in the implementation of all humanistic initiatives aimed at changing the punishment of imprisonment as a socio-cultural institution.
